1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Lighthouse Laser (“Company”, “we”, “us”, or “our”), concerning your access to and use of the lighthouselaserco.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). We are registered in California, United States and have our registered office at 35482 Date Palm St, Winchester, CA 92596.

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use from time to time. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use our Site so that you understand which Terms apply.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

California Proposition 65: WARNING: Drilling, sawing, sanding or machining wood products can expose you to wood dust and other substances known to the State of California to cause cancer. Wood products emit chemicals including methanol known to the State of California to cause birth defects or other reproductive harm. The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

3. USER REPRESENTATIONS

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

4. USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. PRODUCTS

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change. Ordering a product from the site grants Lighthouse Laser the permission to use photos of your finished product in future marketing promotions as well as product listings.

6. COLOR ACCURACY & MATERIAL DISCLAIMER

Due to the nature of custom handcrafted signage, exact color reproduction cannot be guaranteed. Please read and understand the following before placing your order:

Digital Colors vs. Physical Paint Colors

Hex codes, RGB values, Pantone references, and other digital color specifications are designed for use on digital screens and electronic displays, which produce color using light (additive color mixing). Physical paints, stains, and pigments work through subtractive color mixing and cannot replicate digital color values with exact precision. As a result, there will always be some degree of variation between a color specified digitally and the color as it appears on your finished physical product. We will make every reasonable effort to match your requested color as closely as possible, but we cannot guarantee a perfect match and will not accept returns or issue refunds solely on the basis of color variation.

Design Proofs

Prior to production, we provide a digital design proof for your review and approval. This proof is intended to show the layout, text, and general design of your order. YOU MUST REVIEW AND APPROVE YOUR PROOF BEFORE PRODUCTION BEGINS. By approving your proof, you accept responsibility for any errors in spelling, layout, sizing, or design that were present in the approved proof.

Please be aware that the proof is a digital representation only and may not accurately reflect the final finished product. Specifically, the proof may not accurately represent: final paint or stain colors as they will appear on physical materials; wood grain patterns, texture, or color variation; laser engraving depth, burn tone, or char coloring; or the exact appearance of paint or stain applied to engraved areas. Approval of a digital proof does not constitute a guarantee that the final product will match the proof precisely.

Wood as a Natural Material

Wood is a natural product, and as such, every piece is unique. Natural wood will exhibit variation in grain pattern, color, tone, and texture. This is not a defect — it is an inherent and desirable characteristic of working with a natural material, and we believe it adds to the beauty and individuality of each handcrafted piece.

While we carefully select our materials and do not use boards with knot holes, large voids, or structural defects that would compromise your product, you should expect and embrace natural variation including grain pattern differences across the surface, subtle color or tonal variation in the wood, minor mineral streaks or naturally occurring marks, and slight variation in how stain or paint absorbs across different areas of the grain. No two pieces of wood are the same, and no two finished signs will be identical, even when made from the same design. This variation is a feature of handmade wooden goods, not a flaw, and does not constitute grounds for return or refund.

Laser Engraving & Cutting

Laser engraving produces a burn tone that can vary depending on wood species, density, moisture content, and grain direction. Engraved areas may appear lighter or darker than expected based on these natural variables. Paint or stain applied to engraved areas may absorb differently than on unaffected wood surfaces, resulting in slight variation in color or sheen. These characteristics are inherent to the laser engraving process on natural wood and do not constitute defects.

Slight scorching or darkening around laser-cut edges is a normal and expected result of the laser cutting process. If you have specific concerns about the appearance of engraved or cut areas, please discuss them with us before placing your order.

7. PURCHASES AND PAYMENT

We accept the following forms of payment: PayPal, Discover, American Express, Mastercard, & Visa.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in U.S. dollars.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

8. RETURN POLICY

Please review our Return Policy posted on the Site prior to making any purchases. Because all of our products are custom-made to order, we are generally unable to accept returns or offer refunds once production has begun. Exceptions may be made at our sole discretion in cases of verified production errors on our part. Color variation, natural wood characteristics, and laser engraving variation as described in Section 6 of these Terms do not constitute production errors and are not eligible for return or refund.

9. PRODUCTION & TURNAROUND

All products are made to order. Production times will vary based on order volume, design complexity, and material availability. Estimated turnaround times provided at the time of order are good-faith estimates and are not guaranteed. Lighthouse Laser is not liable for delays caused by material shortages, equipment maintenance, or circumstances outside of our reasonable control. Rush orders may be accommodated at our discretion and may incur additional fees.

10. CUSTOM ARTWORK & FILE SUBMISSION

If you supply your own artwork, logos, or design files, you represent and warrant that you have the legal right to use and reproduce such materials. By submitting artwork or files to us, you grant Lighthouse Laser a limited license to use those materials solely for the purpose of fulfilling your order. We are not responsible for the quality of output resulting from low-resolution, improperly formatted, or corrupted files. We reserve the right to request replacement files or decline an order if submitted files are not suitable for production. Preferred file formats include vector files (.ai, .svg, .eps) or high-resolution raster images (300 DPI or higher).

11. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

  • Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  • Use the Site in a manner inconsistent with any applicable laws or regulations.
  • Upload or transmit viruses, Trojan horses, or other malicious material that interferes with any party’s use of the Site.
  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  • Attempt to impersonate another user or person.
  • Harass, annoy, intimidate, or threaten any of our employees or agents.
  • Use the Site as part of any effort to compete with us or use the Site and/or Content for any revenue-generating endeavor or commercial enterprise without authorization.
12. USER GENERATED CONTRIBUTIONS

The Site may provide you with the opportunity to create, submit, post, display, transmit, or distribute content and materials (collectively, “Contributions”). Contributions may be viewable by other users of the Site and through third-party websites and will be treated in accordance with the Site Privacy Policy.

You represent and warrant that your Contributions do not infringe on the rights of any third party; are not false, inaccurate, or misleading; are not obscene, harassing, libelous, or otherwise objectionable; and do not violate any applicable law, regulation, or rule.

13. GUIDELINES FOR REVIEWS

When posting a review, you must: (1) have firsthand experience with the product or service being reviewed; (2) not use offensive, abusive, or discriminatory language; (3) not include references to illegal activity; (4) not post false or misleading statements; and (5) not organize campaigns encouraging others to post reviews, whether positive or negative. We may accept, reject, or remove reviews in our sole discretion.

14. THIRD-PARTY WEBSITES AND CONTENT

The Site may contain links to other websites (“Third-Party Websites”) as well as content belonging to third parties. Such Third-Party Websites and content are not investigated, monitored, or checked for accuracy by us. We are not responsible for any Third-Party Websites accessed through the Site. Any purchases you make through Third-Party Websites are exclusively between you and the applicable third party.

15. SITE MANAGEMENT

We reserve the right to monitor the Site for violations of these Terms; take appropriate legal action against anyone who violates these Terms; and otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

16. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy at lighthouselaserco.com/privacy-policy. By using the Site, you agree to be bound by our Privacy Policy. The Site is hosted in the United States. If you access the Site from any other region, you expressly consent to have your data transferred to and processed in the United States.

17. TERM AND TERMINATION

These Terms of Use shall remain in full force and effect while you use the Site. WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE TO ANY PERSON FOR ANY REASON, INCLUDING FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE.

18. GOVERNING LAW

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.

19. DISPUTE RESOLUTION

To expedite resolution of any dispute, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration. If the parties are unable to resolve a dispute through informal negotiations, the dispute will be finally and exclusively resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”), with arbitration taking place in Riverside, California.

THE PARTIES AGREE THAT ANY ARBITRATION SHALL BE LIMITED TO THE DISPUTE BETWEEN THE PARTIES INDIVIDUALLY. THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS.

Disputes not subject to arbitration include: (a) disputes seeking to enforce or protect intellectual property rights; (b) disputes related to allegations of theft, piracy, or unauthorized use; and (c) claims for injunctive relief. No dispute may be commenced more than one (1) year after the cause of action arose.

20. DISCLAIMER

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR ANY ERRORS OR INACCURACIES OF CONTENT, PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED OR MADE AVAILABLE VIA THE SITE.

21. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF OUR PRODUCTS. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US.

22. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties; or (4) your violation of the rights of a third party, including intellectual property rights.

23. ELECTRONIC COMMUNICATIONS

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.

24. CALIFORNIA USERS AND RESIDENTS

25. MISCELLANEOUS

These Terms of Use and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. If any provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.
